In short, WHETHER these lands are disposed of is a matter of constitutional “directive” and a matter of necessity under the Equal Footing Doctrine. The power delegated to Congress under the Property Clause is “to dispose”. This specific delegation precludes “retention” under federal title. HOW these lands are disposed of is a matter of “policy”. We fail to distinguish between “policy” and “directive”. It was once said that “we often don’t do the right thing until we get the words right”. Bill Moyers
