I also heard that in Oregon, we also have the argument that, by the 1859 Oregon State Admission Act, the only authority that congress reserved to the federal government regarding public domain lands, was the power to dispose of those vacant land and secure title to bona fide purchasers. In Oregon that is the only power the federal government should have been allowed to exercise over public domain lands. If they no longer wanted to dispose of those lands, and they should have turned them over to the state or the counties.
